1. Introduction

1.1. These Terms of Service ("Terms") govern the relationship between:

• Provider: Ladislav Kepl, Vinařice, Czech Republic (contact: ladislav.kepl@gmail.com), hereinafter "Provider"
• User: natural person over 18 years using the service, hereinafter "Mentor"

1.2. The service ("Service") is a parental oversight tool for YouTube viewing via:

• Web dashboard at https://mentor.vinarice.net/
• Chrome browser extension (Manifest V3)
• Optional Android companion app (future)

1.3. By accepting these Terms (checkbox during registration), a contractual relationship is established between Mentor and Provider.

2. Definitions

• Mentor — registered parent user
• Student — child/teenager whose YouTube activity is monitored with Mentor's consent
• Tier — subscription variant (Free, Family, School, Lifetime)
• Subscription — recurring payment for extended functionality
• VPC — Verifiable Parental Consent

3. Registration and user account

3.1. Mentor must be:

• Natural person at least 18 years old with full legal capacity
• Parent / legal guardian of the Student for whom Service is used

3.2. Mentor must provide truthful information at registration.

3.3. For each Student under 15 years Mentor must complete VPC verification (1 CZK card refund / SMS / ID). Without VPC, Student cannot be added.

3.4. Mentor is responsible for safekeeping login credentials.

4. Tiers and payments

4.1. Free — unlimited duration, 1 Student, 7-day data retention.

4.2. Family — 129 CZK/month or 1,290 CZK/year, up to 4 Students, 90-day retention.

4.3. School — B2B, 20 CZK/student/month, minimum 20 students. Governed by separate agreement.

4.4. Lifetime — 2,990 CZK one-time, equivalent to Family forever, limited to 200 licenses.

4.5. Payments are processed by Stripe Payments Europe Ltd. Invoice is generated automatically after payment.

4.6. VAT: prices are stated inclusive of VAT (legal note: if Provider is not VAT-registered, add "Provider is not a VAT payer" clause; otherwise add VAT ID and rate).

4.7. Subscription renews automatically. Mentor may cancel at any time via dashboard — service runs until end of paid period.

4.8. On account deletion data is removed per these Terms (see Privacy Policy).

5. Right of withdrawal (§ 1829 Czech Civil Code)

5.1. Mentor as consumer has the right to withdraw from the contract within 14 days of its conclusion, without reason, via email to Provider.

5.2. Exception — § 1837 CCC: If Mentor consented to start of performance before expiry of 14-day period (e.g., immediately used the dashboard), the right to withdraw expires with full performance. This notice is confirmed by Mentor at registration.

5.3. On withdrawal in 14-day period, Provider returns payment within 14 days by same method as received.

6. Rights and obligations

6.1. Mentor is entitled to

• Use the Service within scope of paid Tier
• Add and manage Students (with VPC if applicable)
• Download and install the Chrome extension
• Log out / delete account at any time

6.2. Mentor must

• Use the Service only for own parental oversight, not commercially without B2B agreement
• Not share login credentials with third parties
• Have VPC for Students under 15
• Inform Students over 15 about data collection
• Not bypass security mechanisms
• Not use the Service for stalking, monitoring adults without consent, or against child's interests

6.3. Provider is entitled to

• Conduct temporary maintenance downtime (24h notice except emergency security)
• Suspend account on suspicion of abuse
• Update the Service (add/change features within Tier)

6.4. Provider must

• Provide the Service per Tier
• Protect personal data (see Privacy Policy)
• Inform about material Service or Terms changes

7. Limitation of liability

7.1. The Service is provided "as-is". Provider does not guarantee:

• 100% availability (SLA: ~99% in PoC, negotiated SLA for School tier)
• Capture of 100% monitored content (Chrome API limits, YouTube changes)
• Compatibility with future Chrome/Brave/Edge versions

7.2. Provider is NOT liable for:

• Damages from improper extension installation
• Damages from Student actions in violation of Terms
• YouTube or Google API outages
• Data loss due to force majeure

7.3. Maximum compensation: paid annual subscription. Free tier max 0 CZK. (Legal note: consumer law does not allow exclusion of liability for gross negligence or intent.)

8. Dispute resolution

8.1. Disputes between consumer Mentor and Provider are primarily resolved by Czech Trade Inspection Authority — www.coi.cz, or ODR platform of European Commission — ec.europa.eu/consumers/odr.

8.2. Contract disputes may be resolved through courts. Competent court is the general court of Provider (legal note: in consumer disputes, consumer has right to sue at place of residence; do not include court jurisdiction clause).

9. Duration and termination

9.1. Free tier: unlimited duration, terminate by account deletion at any time.

9.2. Family / School / Lifetime subscriptions: valid until end of paid period. Auto-renewal can be canceled in dashboard.

9.3. Provider may terminate with 30-day notice in case of:

• Terms violation (after notice)
• Service shutdown (with prorated refund)
• Serious violation (e.g., abuse for stalking) — immediate

10. Closing provisions

10.1. These Terms are governed by Czech law, particularly Act 89/2012 Coll. (Civil Code), Act 110/2019 Coll. (Personal Data Processing), and Regulation EU 2016/679 (GDPR).

10.2. Geographic restriction: Service is primarily intended for users in Czech Republic and Slovakia. Use outside EU/EEA may violate local laws (particularly USA — COPPA). Mentor is responsible for compliance with local regulations.

10.3. If any provision becomes invalid, others remain in effect.

10.4. Provider may amend Terms. Material changes announced 30 days in advance via email. If Mentor disagrees with new version, contract may be terminated.

10.5. These Terms supersede all prior agreements.
